Energy products — the carve-out that matters
Canadian crude oil, natural gas, electricity, refined fuels, and potash benefit from a 10% IEEPA rate rather than the 25% general rate when not USMCA-qualified. The USMCA itself sets 0% on most energy, so the carve-out matters mostly for non-qualifying flows.
- Crude oil (HTS 2709): 0% under USMCA when refinery-of-origin rules met.
- Lumber (HTS 4407, 4409): historically subject to softwood lumber AD/CVD orders independent of USMCA status.
- Electricity, natural gas: 0% under USMCA; 10% IEEPA otherwise.
Lumber and softwood — separate AD/CVD layer
Even when USMCA-qualified, Canadian softwood lumber is subject to AD/CVD orders that have been in place since 2017 and renewed periodically. Combined AD + CVD rates have ranged from 8% to 20% depending on the producer and review cycle. Track the current order via /pulse for updates.
