Energy products — the carve-out that matters

Canadian crude oil, natural gas, electricity, refined fuels, and potash benefit from a 10% IEEPA rate rather than the 25% general rate when not USMCA-qualified. The USMCA itself sets 0% on most energy, so the carve-out matters mostly for non-qualifying flows.

  • Crude oil (HTS 2709): 0% under USMCA when refinery-of-origin rules met.
  • Lumber (HTS 4407, 4409): historically subject to softwood lumber AD/CVD orders independent of USMCA status.
  • Electricity, natural gas: 0% under USMCA; 10% IEEPA otherwise.

Lumber and softwood — separate AD/CVD layer
